TERMS & CONDITIONS AND PRIVACY POLICY

THIS AGREEMENT sets forth the terms under which we, GONE TRAVELING LLC – ‘Gone Traveling Tours’ agree to provide the Client with accommodations, tours, transfers, and other touristic services planned and paid for ahead of the first day of the travel dates.  

 

RESERVATIONS.  To begin the process of reservations, the Client must fill out all the information requested in the Reservation Form as well as inform Gone Traveling about any special requirements and special requests. Gone Traveling distinguishes between special requirements (“Special Requirements”) and special requests (“Special Requests”).

 

Special Requirements are items fundamental to the holiday or other travel, that must be discussed and confirmed at the time of the reservation so that Gone Traveling can do its utmost to honor them. An example of Special Requirements includes, without limitation, medical, physical, religious, or other requirements.

 

Special Requests are those requests which are not required but would make the trip more enjoyable. Gone Traveling will try to meet any special requests, which are items not essential to the holiday or other travel, but do not guarantee anything.

When you hire GONE TRAVELING LLC to help plan your travel, you are speaking with professional travel advisors to ensure that your trip is tailored to your taste, preferences, and budget.  In your package, other than accommodations, transportation, and activities, you receive the benefits of skilled professionals with experience, well-trained in the tourism industry, and travel oriented.

PROFESSIONAL FEES.

GONE TRAVELING LLC requires a payment of a professional non-refundable fee at the time of package confirmation with the following amounts:

  • $60   for customized, independent travel for up to 5 people traveling together.

  • $100 for customized, independent travel from 5 to 10 people traveling together.

  • $120 for customized, independent travel for over 10 people traveling together.

 

CONFIRMATIONS AND PAYMENTS. Gone Traveling is only bound by a reservation after confirming the requested services and receipt of full payment. Once the services requested are confirmed there are three (3) days to pay 30% (non-refundable) of the total price of the trip. If the payment is not made within three (3) days Gone Traveling reserves the right to release any reservations made.

The balance of the price must be credited to Gone Traveling not later than 45 days before the starting date of the trip that has been booked. Reservations for which payment is not duly received as stated above will be automatically canceled. If the reservation is made within 45 days before the starting date of the tour, a single payment must be made.

 

The payment shall be made in USD by check, wire transfer, or credit card (card (Visa, Mastercard, American Express, Discover) based on the invoice of GONE TRAVELING.

 

CHANGES AND CANCELLATIONS. The Client shall submit changes made to the applications as soon as possible.

The Client shall be obligated to immediately inform Gone Traveling of any circumstances which have or may influence the course of performing the requested services.

 

REFUND POLICY. Cancellations are subject to the following Refund Policy:

A 30% Deposit is Non-refundable.

BALANCE OF THE PRICE.

44 to 30 days: 50% of the total payment will be refunded.

29 to 15 days: 20% of the total payment will be refunded

14 to 0 days: 100% of the total payment will NOT be refunded

 

The aforementioned refund policy is not valid for booking scheduled flights that are always non-refundable (unless otherwise indicated by the airline booking policy).

Any or all Changes and Cancellations must be requested in writing and delivered to Gone Traveling via e-mail to info@gonetravelingtours.com.

 

If you cancel or cannot take your tour as a consequence of force majeure (“Force Majeure”), Gone Traveling will refund the amount you have paid less any non-recoverable out-of-pocket costs Gone Traveling has incurred on your behalf - car rentals, admissions, hotel reservations, tickets, etc.

 

Force Majeure fire, earthquake, flood, explosion, strike, riot, war, terrorism, Pandemic event, or similar event beyond either Party’s reasonable control (each a “Force Majeure Event”). However, if a Force Majeure Event occurs, the affected Party shall, as soon as practicable:

 

(a) Notify the other Party of the Force Majeure Event and its impact on performance under this Agreement; and

 

(b)  Use reasonable efforts to resolve any issues resulting from the Force Majeure Event and perform its obligations under this Agreement.  

 

PRIVACY POLICY. Gone Traveling is committed to protecting your privacy. We will keep all the information that you share with us confidential. We only collect your personal information to process billing, book tours, and hotels PRIVACY POLICY. Gone Traveling is committed to protecting all the other necessary services to provide a personal and customized travel experience for You.  We do not sell, rent, or share your information with any outside parties other than those suppliers of booked services for your travel.

 

PRICES. All prices are subject to increase up to the receipt of final payment due to an increase in our costs, such as but not limited to: increases in air, land, or sea fares, currency fluctuations, fuel surcharges, airport security charges, and any other imposed taxes from the government. After the final payment, the only cost increases can be for newly imposed governmental taxes. Gratuities are not included if not specifically indicated.  

 

DOCUMENTS ACCURACY. While Gone Traveling pays specific attention to verifying the accuracy of all the information on the Client’s itinerary and vouchers, it is the Client's responsibility to read meticulously and review the final documents upon receipt. Failure to contact us in time to allow for the correction and the emission of the new documents could result in the loss or cancellation of part of the reservation. We won’t be responsible for any of the Client's negligence or oversight.

ERRORS. In case of any human or computer billing error, Gone Traveling reserves the right to issue a new invoice with the corrected billing.

 

ERRORS. Gone Traveling works with the Client before, during, and after the trip to ensure that the vacation goes easily and according to plan. But unpredictable problems might arise. Gone Traveling and the local providers must be informed right away if any problem might occur.

 

REFUNDS AND COMPLAINTS. Refund requests or complaints must be written and sent to info@gonetravelingtours.com.

 

RESPONSIBILITY. Gone Traveling is not responsible for any inattentive or persistent act or failure to act of any specific person or entity, nor for any act or inaction or any other third party not under its control. Without limitation Gone Traveling is not liable for injuries, loss, accident, delay, difficulty, violation, or irregular occurrence of any kind and not under its control including any issue or failure caused by any of the third parties, such as airlines, trains, hotels, restaurants, buses, taxis, and any other mean of transportation.

TOUR OPERATOR PROFESSIONAL LIABILITY INSURANCE. 
This essential policy offers comprehensive coverage for "all operations necessary and incidental" to a travel agency or tour operation, excluding specifically excluded claims. It addresses covered claims and lawsuits brought from anywhere in the world.
